The Right to Privacy in the Dock.

The right to privacy is in the dock again.  Ms Ruth Hickey is taking an action against the Sunday World over photographs published. It is claimed her right to privacy was breached by the publication of the photographs. The images published were of  her leaving the births, marriages and deaths office in Dublin on May 10th, 2006 with David Agnew and their son. Mr Agnew is the former husband of entertainer “Twink”.

In argument yesterday at the High Court, Dublin, Senior Counsel, Turlough O’Donnell, described the newspaper as having shown a “merciless contempt” for Ms Hickey’s privacy and that of her son.

The newspaper denies any breach of privacy claiming that the plaintiff had given an interview to “Social and Personal Magazine” prior to the birth and that nowhere was the infant visible in the photographs published.

The case was heard by president of the High Court, Mr Justice Nicholas Kearns and judgement has been reserved.
